Accepting An Offer
The Price Is Not Always Right
Don’t be fooled - a bigger first offer is not always better! The initial offer is usually not final, as terms and conditions may influence the final price. I’ll help you quickly and thoroughly evaluate every proposal for the bottom line without compromising your marketing position to help you identify the best fit with your goals.
Negotiating The Right Way
I take the ethical responsibility of fairly negotiating contractual terms very seriously. It is my fiduciary duty to represent the seller in the best legal and personal way possible especially through contract negotiations. Seller agents are not allowed to share any information with the buyer’s agent that isn’t previously agreed upon by the seller (for example, the reason for selling). Additionally, as the seller, you may have to navigate and consider multiple offers before ratifying the one you judge to be the most suitable for you – and as your agent, I will guarantee a thorough and objective assessment of each offer to help guide ou to the right choice.
The Initial Agreement and Deposit
The purchase contract is a legal agreement between a potential purchaser and the property’s seller. While laws vary from state to state, many agreements require “consideration” to become legally binding. This consideration, or earnest money deposit, may be held in the closing agent’s escrow account pending the fulfillment of conditions or contingencies in the effective agreement.
Some important tips to keep in mind to streamline the process even further:
Stick to the timeline. Once you have accepted an offer you and the buyer have strict deadlines to mark every stage in the process of closing the real estate contract. Meeting the requirements on time ensures a smooth flow of negotiations so that each party involved is not in breach of their agreements. During the process I will keep you constantly updated, so you will always be prepared for the next step.
Keep written records of everything. As part of an agent’s fiduciary duties, she or he should provide you with copies of all verbal agreements including counter-offers and addendums and to convert them into written agreements to be signed by both parties. I will assist you in drafting all the paperwork for any counter offers, inspection remedies, closing date changes, and anything else that may arise during the sale of your property. My goal is to take the stress of selling off your shoulders and make the experience as easy, transparent and as seamless as possible!
